Extract from the 1839 School Trust Deed
concerning the purchase of land in Nayland Road

(Trust Deed dated 23rd March 1839)


Release of a piece or parcel of land or ground in the Parish of Bures St Mary in the County Of Suffolk for a National School in the said Parish of Hamlet of Bures

This indenture made between Osgood Hanbury of Hotfield Grange Coggeshall in the County Of Essex on the one part and Osgood Hanbury of Lombard Street, London, The Rev Arthur Hanbury Vicar of Bures St Mary with Bures Hamlet, John Garrad of Bures St Mary Malster, John Boggis of the same place Farmer, and Grimmard Wood of the Hamlet of Bures aforesaid Farmer and Church wardens of the said Parish and Hamlet of the other part

……….contracted or agreed for the absolute purchase of the piece or parcel of land or ground and heriditaments hereinafter described and also released or otherwise assured or intended so to be and the fee simple and inheritance of the said heriditaments free from all encumbrances at the price or sum of £1………….(NOTE 1)

………….All that piece of parcel of land or ground lying and being in the parish of Bures St Mary aforesaid abutting north and south east of lands of the said Osgood Hanbury (NOTE 2) and south west leading from Bures to Nayland upon lands held by Thomas Scowan containing by measurements sixteen rods or thereabouts upon which said piece of land or parcel of land or ground or on part thereof a school house with its appurtenances has lately been erected (NOTE 3)and built and is more particularly described by the plans drawn in the margins of those present

To the only use and behoot of the said Osgood Hanbury the younger his heirs and assignees and the said Arthur Hanbury, John Garrad, John Boggis and Grimmard Wood their successors and assigns absolutely and forever upon their trust nevertheless to permit the same to be used for ever hereafter as a school for the purpose of educating the children of the poor according to the principles of the National Society

The deed of 23rd March 1839 was enrolled in Her Majesty`s High Court of Chancery the 21st June 1842 being first duly stamped according to the tenor of the statutes made for that purpose.

….. The Lords of Her Majesty`s Treasury have advanced the sum of £40 (NOTE 4)towards the expense of erecting furnishing and fitting of the said school upon conditions of the same being open to inspection as hereinafter mentioned, it shall also be open at all reasonable times to the inspection of the Inspector or Inspectors appointed or to be appointed in conformity with the Order in Council being this date of 10th August 1840
